Agreement

These terms are an agreement between you and Scalemind LLC. Scalemind LLC operates Wakeel. Wakeel is a product of ISR Services.

In these terms, “we” means Scalemind LLC, and “you” means the seller who uses Wakeel.

When you create an account or use Wakeel, you accept these terms and our privacy policy. If you do not accept them, do not use Wakeel.

The service

Wakeel helps online sellers who sell with cash on delivery. Sellers build store pages, run ads on Meta and TikTok, receive orders, confirm them by AI phone call or WhatsApp, ship them with delivery carriers, and follow the results.

Accounts

• You sign in with Google, and you verify your phone number.
• You must be 18 years or older.
• You give true information, and you keep it up to date.
• You are responsible for the team members that you invite, and for what they do in your store.

Your duties as a seller

• Sell only lawful products.
• Obey the laws on e-commerce, consumers and personal data. In Algeria, this includes Law 18-05 on e-commerce and Law 18-07 of 10 June 2018 on the protection of natural persons in the processing of personal data.
• Before you use AI calls, tell your buyers that an AI agent can call them, and that the call is recorded and transcribed. Also tell them that you can send them messages, and how you use their data.
• Have the rights to the content that you upload: texts, photos, videos and logos.
• Obey the rules of Meta, Google, TikTok and your delivery carriers.

Forbidden use

Do not use Wakeel to do these things:

• Sell illegal or counterfeit products.
• Send spam, or harass people.
• Misuse AI calls, for example to call people who did not order, or to mislead people.
• Copy the service, or take it apart to learn how it is built (reverse engineering).
• Go around the limits of your plan or the security of the service.

AI features

• AI results can be wrong. Check them before you use them.
• You are responsible for what you publish and for your ad campaigns, also when the AI made them.
• By default, Wakeel asks you before the AI spends money on ads or publishes something new. If you turn these questions off, you are responsible for what the AI does.

Third-party services

Wakeel connects to the services of other companies, such as Meta, Google, TikTok, payment providers and delivery carriers. Their own terms apply when you use them.

We do not control their decisions. For example, we are not responsible when a platform bans an ad account, or when a carrier delivers late.

Plans, credits and payments

• You pay for plans and credits by card through Stripe, or with CIB and Edahabia cards through SlickPay.
• AI features, calls and media use credits.
• When a payment is 3 days late, the AI features and publishing pause. Your data stays safe.
• For a question about a refund, contact us.

Your content

You keep the rights to your content. You give us the right to host, copy and process it only to run the service for you.

The Wakeel software and the Wakeel brand stay ours.

Data protection

Our privacy policy explains how we use personal data. We process the data of your buyers for you and on your instructions.

Suspension and end

You can stop using Wakeel at any time. You can ask us to delete your data. See Delete your data.

We can suspend or close your account if you break these terms, if your use creates a legal risk, or if you do not pay the amounts that you owe.

No guarantee

We give the service “as is”. We do not promise sales, results or deliveries.

Limit of liability

As far as the law allows, we are not liable for indirect loss or for lost profit.

As far as the law allows, our total liability is limited to the amounts that you paid us in the 12 months before the claim.

Changes to these terms

We can change these terms. We then update this page and its date. For important changes, we tell you in the app or by email. If you use Wakeel after a change, you accept the new terms.
